These conditions are intended for consumers with full legal capacity. These conditions apply to all orders you place on this site.

We do our utmost to satisfy you. On this site, we present all the essential characteristics of the goods. We will be attentive to the comments that you send us.

These terms and conditions are presented in the French language.

We operate as an operator and are not subject to any particular professional rules.

1 – The different steps to follow to conclude an online contract

1.1 Ordering

You make your reservation via the https://www.loeuillade.com/je-reserve/ page. Here you’ll find all the instructions you need to complete your booking.

1.2 Contract validation

Once your booking has been completed, a confirmation message appears. It summarizes all the products and options selected.

In this order form, you must check all the information you have entered (booking dates, number of people, breakfast options).

If you do not need to modify the form, you must read the present conditions. If you accept them, you must tick the box “I agree to accept the General Terms and Conditions of Sale”.

You must also read the Privacy Policy and accept it by ticking the box “I accept the Privacy Policy”.

To proceed with your order, you must click on “Book now”.

After payment on our secure server (see “Payment”), an acknowledgement of receipt is displayed. It confirms that your order has been registered, and informs you that a confirmation e-mail will be sent to you as soon as possible.

You also have the option of making a booking request with payment by bank transfer. A form is available for you to express your reservation request. On receipt of your request, we will send you the amount to be paid and our bank details so that you can make the transfer. We will confirm your reservation by e-mail upon receipt of the transfer to our bank account.

1.3 Technical means for identifying and correcting errors

Up to the “Book now” stage of order validation, you may at any time identify and correct any errors you may have made when entering your data.

In the case of bookings involving payment by bank transfer, you may identify and correct any errors you may have made when entering your data on receipt of the e-mail including our price proposal. Please do not hesitate at this time to inform us of any correction you wish to make in response to our proposal so that we can adjust it.

2 – Archiving and contract access procedures

We will archive order forms and invoices on a reliable and durable medium for up to 28 months.

Under the General Data Protection Regulation in force in France and the European Union since May 25, 2018, you may exercise a right to modify or delete this data by contacting us here.

3 – Legal and contractual warranties

3.1 Legal warranties

In accordance with the legal provisions in force relating to the conformity of the goods to the contract, in terms of hidden defects, we will reimburse you for any stay that does not correspond to your order.

3.3 Liability

We do our utmost to satisfy you. We are responsible for the proper execution of these terms and conditions. Nevertheless, we cannot be held liable for any unforeseen circumstances, force majeure or the unforeseeable and insurmountable act of a third party to the contract.

Our gîte is intended for personal use, reserved for private customers: our liability is not applicable in the case of professional use.

4 – Delivery times, costs and procedures

4.1 Delivery procedures

The start and end of your stay at L’Œuillade are subject to an inventory of fixtures on arrival and departure.

4 .2 Delivery times

Your arrival and departure times at L’Œuillade are in accordance with those indicated on our website or by the person in charge of reception and departures, who will contact you by e-mail, SMS or telephone.

In the event of a delay in your arrival time, we will inform you by e-mail as soon as possible and propose a new time.

5 – Prices

The prices of our products are indicated in euros, all taxes included. They include the cost of processing your order.

6 – Terms of payment and security

We collect your payment when you place your order.

If you pay for the entire rental, 25% of the amount you pay is a deposit. Both owner and tenant have the right to cancel. If the tenant withdraws, he loses the deposit paid (25% of the total). If the owner withdraws, he must reimburse the tenant twice the amount of the deposit (Article 1590 of the French Civil Code).

6.1 Payment methods

You can pay for your stay at www.loeuillade.com by various methods:

• Credit card
• Bank transfer
• PayPal

Payment by credit card is made via the secure bank servers of our partner (PayPal). This means that no banking information about you is transmitted via our site. Payment is therefore perfectly secure; your order will be registered and validated as soon as your bank accepts payment.

6.2 Security

Bookings via our site are secured by SSL (Secure Socket Layer). All data entered is encrypted.

7 – Satisfaction or your money back:

how to exercise your right to cancelIn accordance with the law:

• In the event of cancellation up to 30 days before the date of arrival, you will receive a full refund.
• In the event of cancellation up to 15 days before the date of arrival, you will be reimbursed 75% of the total amount of the reservation.
• In the event of cancellation within the last 14 days, you will be reimbursed 50% of the total amount of the reservation.

You do not need to justify your reasons. In accordance with the above schedule, we will reimburse you within 30 days of your cancellation. On our proposal, you may also opt for another method of reimbursement.

8 – Duration of contract and validity of price

Prices are exclusive of tax (VAT not applicable, art. 293 B of the CGI).

The loeuillade.com website remains the sole property of L’ŒUILLADE.

Tenants have the right to use the property for the duration of their stay. They may not alter the interior or exterior of the gîte by any masonry work or decoration whatsoever.

9 – Applicable legislation/Competent jurisdiction

In the event of a dispute as to form or content, the Customer will first contact L’ŒUILLADE to obtain an amicable solution.

These General Terms and Conditions of Sale are written in French and will be executed and interpreted in accordance with French law. Any dispute that may arise from their validity, interpretation or execution will be submitted to the French Courts, which have exclusive jurisdiction. The Customer acknowledges accepting their exclusive jurisdiction. L’ŒUILLADE reserves the right to request and obtain injunctions or orders for the defence of its rights under the terms hereof.

11 – Intellectual property

L’ŒUILLADE is the owner of the right to distribute the elements appearing on the site and in particular the photographs.

All the elements (drawings, models, illustrations, images, videos, soundtracks, texts, logos, brands, etc.) making up the Site are the property of L’ŒUILLADE. In accordance with the provisions of the Intellectual Property Code, it is forbidden to reproduce in full or in part, by any process whatsoever, to distribute, to publish, to transmit, to modify or to sell all or part of the content of the Site, or to create works derived from it.

The L’ŒUILLADE brand displayed on the Site, whether registered or not, as well as the domain name “loeuillade.com” is and will remain the property of L’ŒUILLADE. Any reproduction, distribution, transmission, modification or use of this brand without the express prior consent of L’ŒUILLADE for any reason whatsoever is prohibited.

12 – Personal information

When you make your reservation on our website, you will be asked to enter your first name, last name, email address and mobile phone number in the form. This data will be used to manage your stay in our gîte and billing. As part of the billing management of our establishment, this data is kept for a maximum of 6 years after the reservation date. Under the General Data Protection Regulation in force in France and the European Union since May 25, 2018, you can exercise the right to modify or delete this data by contacting us here.

13 – No warranty

L’ŒUILLADE cannot guarantee or affirm:

• That the Site is free of viruses, data-crushing programs, Trojan horses or other destructive material;
• That the information contained in the Site is accurate, complete or up to date.

The Site may contain technical inaccuracies or other defects, L’ŒUILLADE does not guarantee the correction of these defects. The Site and its content are presented “as is” and “according to availability”.
